In Victoria the land use planning system is integrated with the environment protection framework to enable consideration of land contamination (as well as other environmental concerns such as noise, water and air quality) in decision making on the use and development of land. New environment protection legislation became operational on 1st July 2021- and in response, there have been some changes to the planning system which ACLCA members may wish to be aware of.
In this webinar, DELWP and EPA will present planning scheme amendment VC203, which updates the Victorian Planning System to incorporate EPA’s reformed environmental audit system, including the new preliminary risk screen assessment (PRSA). The amendment also updates references to relevant legislation and guidelines, and new types of EPA approvals, works approvals, licences and notices.
Specific topics covered in the webinar include:
- The updated Ministerial Direction No 1 - Potentially Contaminated Land.
- The updated Planning Practice Note 30 - Potentially Contaminated Land, providing guidance to planners and applicants on planning system requirements regarding potentially contaminated land.
- A new “Planning for Environment Protection” website with guidance on the updated provisions and links to relevant EPA information.
These changes follow from a public consultation process involving many ACLCA members (submissions and responses are available at Engage Victoria.)
The webinar provides an opportunity for those who submitted, and others who are interested, to understand the final policy provisions and to discuss any relevant questions with DELWP and EPA.

Jeremy Aarons is a Project Manager in the Environment Protection branch at the Department of Environment, Land, Water and Planning (DELWP), part of the team implementing the Victorian government response to the 2016 Independent Inquiry into the EPA. Jeremy led the development of Victoria Unearthed, an interactive mapping system with information on potentially contaminated land and land use history, and has been leading reforms to Victoria’s land use planning framework for contaminated environments.
Julia Noel is a Policy Officer in the Environment Protection at the Department of Environment, Land, Water and Planning (DELWP), part of the team implementing the Victorian government response to the 2016 Independent Inquiry into the EPA.
Nicholas Kennedy is a Senior Planning Officer (Contaminated Land) within the Major Projects and Planning Unit of EPA Victoria. In his role, Nicholas provides advice on the investigation, clean up and management of contaminated land and groundwater through the land use planning system. Nicholas has recently been involved in the drafting of contaminated land policy and guidance stemming from the introduction of the Environment Protection Act 2017, as well as providing advice on potentially contaminated land for numerous planning projects of state significance.
Alison McRae is a Senior Environmental Audit Officer in the Environmental Audit Unit at EPA Victoria. She recently returned to this role after spending the last two years as a Subject Matter Expert in EPA’s Transformation delivery program to implement the new Environment Protection Act 2017, with a specific focus on the environmental audit system.
